Airport Concessions Disadvantaged Business Enterprise (ACDBE)

49 CFR 23.3

A firm seeking to operate as a concession that is a for-profit small business concern:

1. That is at least 51 percent owned by one or more individuals who are both socially and economically disadvantaged or, in the case of a corporation, in which 51 percent of the stock is owned by one or more such individuals; and
2. Whose management and daily business operations are controlled by one or more of the socially and economically disadvantaged individuals who own it.

Your annual revenues, averaged over a 5-year period, must not exceed an overall cap of $56.42 million. The standards for banks, telecommunications companies, and rental car companies are based on the number of employees. 49 CFR 23.33.

51% of your company ownership must be under the Personal Net Worth standard of less than $2.047 million (this amount excludes a primary residence and ownership interest in the company applying for certification). 49 CFR 23.35

A SEDO (Socially and Economically Disadvantaged Owner) must own at least 51 percent of each class of ownership of the firm. Each SEDO whose ownership is necessary to the firm’s eligibility must demonstrate that their ownership satisfies the requirements of this section. If not, the firm is ineligible. 49 CFR 26.69(a)

Must have the experience, expertise, and control of the day-to-day operations of the firm. 49 CFR 26.7

Concession 49 CFR 23.3 

A concession is a business located on an airport, that is engaged in the sale of consumer goods or services to the public under an agreement with the airport, another concessionaire, or the owner or lessee of a terminal. 

OR 

A business conducting one or more of the following covered activities, even if it does not maintain an office, store, or other business location on an airport, as long as the activities take place on the airport: 

• Management contracts and subcontracts
• Web-based or other electronic business in a terminal 
• An advertising business that provides advertising displays 
• A business that provides goods and/or services to concessionaires
